1. General Provisions
These Terms of Service (hereinafter — "Terms") govern the relationship between LLC "Bitcom" (hereinafter — "Company", "we") and the user (hereinafter — "User", "you") in connection with the use of the Bitcom platform (hereinafter — "Platform"), available at bitcom.tj.
By using the Platform, you confirm that you have read these Terms, fully understand and agree with them. If you do not agree with any provisions of the Terms, you may not use the Platform.
2. Legal Framework
LLC "Bitcom" is a digital asset service provider and an official entity of the Technology Park for Software Products and Information Technologies (IT Park Dushanbe).
The Company operates on the basis of:
- Law of the Republic of Tajikistan "On Technology Park"
- Government Resolution of the RT dated July 31, 2024 No. 440 — Regulation on the Technology Park for Software Products and Information Technologies
- Civil Code of the Republic of Tajikistan
- Regulatory legal acts of the Agency for Innovation and Digital Technologies under the President of the Republic of Tajikistan
3. Key Definitions
The following terms are used in these Terms:
- Digital assets — digital representation of property, the circulation of which is carried out in distributed decentralized information system technology or similar technologies
- Token (digital sign) — a record in the transaction block registry (blockchain) or other distributed information system used to confirm the owner's right to civil law objects and/or as a digital asset
- Blockchain (transaction block registry) — a sequence of blocks with transaction information, built using cryptographic methods of information protection
- Service provider — a legal entity, resident of the Republic of Tajikistan, providing services for the purchase, sale, exchange, storage, and management of digital assets
- Smart contract — a contract that, through a computer algorithm, is designed to automate the execution of terms and agreements of the parties
Important: Transactions with digital assets involve financial risks. The value of digital assets can fluctuate significantly. You bear full responsibility for your decisions.
4. Description of Services
In accordance with the IT Park Regulation, the Company as a service provider offers the following services:
- Purchase and sale of digital assets for somoni, foreign currency, and electronic money
- Exchange of digital assets for other digital assets
- Storage of digital assets in virtual wallets
- Information about digital asset rates
- Customer support consulting
The Company reserves the right to change, suspend, or terminate the provision of any services in accordance with the law.
5. Registration and Account
To use the Platform's services, you must:
- Be of legal age (reach 18 years old)
- Be a resident of the Republic of Tajikistan or have the right to conduct transactions in accordance with the laws of your jurisdiction
- Complete the registration procedure and, if necessary, identity verification (KYC)
- Provide accurate and up-to-date information about yourself
You agree to maintain the confidentiality of your account data and are responsible for all actions performed using it.
6. Transaction Procedure
When making exchange transactions:
- The exchange rate is fixed at the time of order confirmation
- The transaction is considered completed after both parties receive funds
- Processing time depends on the payment method and can range from a few minutes to 24 hours
- Minimum and maximum transaction amounts are set by the Company and may change
7. Fees and Limits
Current fees and limits are displayed on the Platform at the time of the transaction. The Company has the right to change fees and limits. Changes take effect from the moment of their publication on the Platform.
8. User Obligations
The User agrees to:
- Comply with the legislation of the Republic of Tajikistan and international norms
- Not use the Platform for money laundering
- Not use the Platform for financing terrorism or other illegal activities
- Provide only accurate information
- Keep personal data up to date
- Notify the Company of suspicious activity in the account
9. Prohibited Activities
It is prohibited to use the Platform for:
- Money laundering or terrorism financing
- Fraud or deceiving third parties
- Violating sanctions regimes
- Trading in prohibited goods and services
- Hacking, attacks, or disrupting Platform operation
- Creating multiple accounts
10. Limitation of Liability
The Company is not responsible for:
- Losses resulting from cryptocurrency rate fluctuations
- Transaction processing delays caused by blockchain network technical issues
- User errors when entering details
- Actions of third parties who gained access to the User's account
- Force majeure circumstances
11. Suspension and Termination of Access
The Company has the right to suspend or terminate the User's access to the Platform in case of:
- Violation of these Terms
- Suspicion of fraudulent activity
- Requirements of regulatory authorities
- Unsuccessful identity verification
- Other justified reasons
12. Dispute Resolution
All disputes arising from these Terms are resolved through negotiations. If agreement is not reached, the dispute is referred to the court at the location of the Company in accordance with the legislation of the Republic of Tajikistan.
13. Applicable Law
These Terms are governed and interpreted in accordance with the legislation of the Republic of Tajikistan.
14. Changes to Terms
The Company reserves the right to make changes to these Terms. Changes take effect from the moment of their publication on the Platform. Continued use of the Platform after changes are made means acceptance of the new version of the Terms.
